Doubts About Eligibility for Unemployment Benefits

When you are a member of an unemployment insurance fund (a-kasse), situations may arise when your eligibility for unemployment benefits is questioned. Here, you can navigate through the case process if such situations arise.

The problem may concern unemployment benefits and other benefits that you have already received or will receive. 

The doubt may arise due to the information you provide or what we receive from your job centre, the Danish Agency for Labour Market and Recruitment, the Danish Customs and Tax Administration, etc. 

In these situations, there are requirements for how Akademikernes A-kasse must handle the matter. You are also covered by several rights and obligations that we would like to guide you through: 

  • ”Consultation of parties involved” 
  • ”We pay out benefits subject to repayment” 
  • ”You have the right to comment on your case” 
  • ”You have the right to be represented” 
  • ”Consent” 

Consultation of parties involved 

If we become aware of information that raises doubts about your eligibility for unemployment benefits, we will ask you for a statement before we decide the case. 

You have one week to respond to our letter. We will make a decision based on the information available if you do not meet the response deadline. 

We will also make a decision on this basis if your response indicates that you are unwilling to cooperate in clarifying the matter. 

We pay out benefits subject to repayment 

Even if there is doubt about your eligibility for unemployment benefits, we are not permitted to simply stop your payments. 

However, we must continue to pay you benefits until we can make a decision on the matter. Either because the matter has been sufficiently examined or on the present basis if you do not want to contribute to clarifying the matter. 

If it turns out that you were not entitled to the benefits, you will be required to repay us. Interest will be added to the repayment amount if the amount exceeds an amount equivalent to four weeks of unemployment benefits. 

You are obliged to provide us with the information we need to assess your eligibility for unemployment benefits, early retirement benefits (efterløn), tax-exempt premiums or other benefits we administer. 

You have the right to comment on your case 

You can request a case to be postponed because you want to submit a comment on the case. You will then be given a deadline of one week to submit your statements. The deadline can be shorter or longer if the circumstances warrant it. 

We will always grant your request for such a postponement unless: 

  • After a specific assessment, we consider the statement unnecessary and delaying the case processing time instead. 
  • Postponing the case will mean that other deadlines – set by other authorities, for example – can no longer be met. 
  • Other provisions and guidelines have ensured your right to make a statement. 

You have the right to be represented 

You can choose to obtain assistance from others while the case is pending. Or let someone else attend to the case for you. However, this does not apply if we cannot process the case without your involvement. 

If you allow others to assist or represent you, you will usually need to sign a power of attorney or something else so we can see that they are acting on your behalf. However, this does not apply if you choose to be represented by a lawyer, accountant or your trade union.
